Find out about the new EU data protection legislation and how it affects your organisation
The new EU data protection legislation was finally agreed at the beginning of 2016. The General Data Protection Regulation (GDPR) is the new framework that will come in to force in May 2018. It is going to be the biggest change and development in data protection law for the last 20 years, leading to a higher level and better harmonization of data protection across the EU. The new regulation will also apply to organisations located outside of the EU if they offer goods or services within EU.
As the new legislation will apply to all types and sizes of businesses, it is important to make sure that your organisation is prepared and has in place all processes and procedures to comply with the GDPR before May 2016. Once the agreement comes into force there will be sanctions and significant fines for all non-compliant data processors and controllers.
The GDPR introduces new obligations in regards to accountability, data protection by design, data subject consent, role of data processors, right to erasure, international data transfers and breach notification. As many of the new processes and standards will take time to implement and fully integrate with other parts of the business, many organisations are already reviewing their current procedures and moving to compliance.
Many companies spend a lot on security but do not have any procedures in place when it comes to data destruction. The Right to Be Forgotten (RTBF) is an important part of the new framework that requires data controllers to not only erase requested data, but also to have a proof of this erasure.
